Your access to and use of the services are conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use our services.

By accessing or using our services, you agree to be bound by these Terms. If you disagree with any part of the terms, you do not have permission to access our services.

1. Definitions

In these Terms, the following definitions apply:

• "Terms" means these Terms and Conditions.
• "Services" means the furniture repair, restoration, and related services offered by Furniture Repair.

• "User," "you," or "your" means any individual or entity that accesses or uses our Services or Website.
• "Content" means any text, graphics, images, music, software, audio, video, information, or other materials appearing on or through the Services.
• "Quote" means a formal estimate provided by us for specific furniture repair or restoration services.
• "Project" means the furniture repair or restoration work to be performed by us based on an accepted Quote.
• "User Content" means any Content that a User posts, uploads, publishes, submits, or transmits to be made available through the Services.

2. Account Registration and Use

2.1 Account Creation

To use certain features of our Services, you may need to register for an Account. When you register, you agree to provide accurate, current, and complete information and to update this information to maintain its accuracy. You are responsible for safeguarding your password and for all activities that occur under your Account. You agree to notify us immediately if you suspect any unauthorized use of your Account.

2.2 Age Requirement

You must be at least 18 years old to create an Account and use our Services. By creating an Account, you represent and warrant that you are at least 18 years old.

2.3 One Account Per User

You may not create more than one Account without our express permission. We reserve the right to terminate any duplicate Accounts.

2.4 Account Termination

We reserve the right to suspend or terminate your Account at any time for any reason, including but not limited to violation of these Terms. You may also terminate your Account at any time by contacting our customer service.

3. Services and Quotes

3.1 Service Descriptions

We provide various furniture repair and restoration services as described on our Website. The specific details, pricing, and timelines for each service may vary based on the nature and scope of the project.

3.2 Quotes and Acceptance

Before commencing any Project, we will provide you with a written Quote detailing the scope of work, estimated timeline, and pricing. All Quotes are valid for 30 days from the date of issue, unless otherwise stated. Your acceptance of a Quote, whether in writing or through payment of a deposit, constitutes a binding agreement to these Terms.

3.3 Estimates and Final Pricing

All Quotes are estimates based on our assessment of the work required. In some cases, additional issues may be discovered during the repair process that were not visible during the initial assessment. If such issues are found, we will notify you before proceeding with any additional work that would increase the total cost beyond the original Quote.

3.4 Timeline Estimates

Any timeline provided in a Quote is an estimate and not a guarantee. We strive to complete all Projects within the estimated timeframe, but delays may occur due to material availability, complexity of the repair, or other factors beyond our control.

3.5 Changes to Orders

If you wish to change the scope of work after accepting a Quote, you must request such changes in writing. We will inform you if the requested changes will affect the price or timeline, and such changes will only be implemented after your written approval.

4. Payment Terms

4.1 Deposits

A non-refundable deposit of 50% of the total quoted price is required to commence work on a Project, unless otherwise specified in the Quote. The deposit reserves your place in our work schedule and may be used to purchase materials specific to your Project.

4.2 Final Payment

The remaining balance is due upon completion of the Project and before delivery or pickup of the furniture. For Projects exceeding 30 days in duration, we may request progress payments at specific milestones as outlined in the Quote.

4.3 Payment Methods

We accept payment by credit card, bank transfer, and cash. Credit card payments may incur a processing fee of up to 3%, which will be disclosed at the time of payment.

4.4 Late Payments

Payments not received within 14 days of the due date may accrue interest at a rate of 1.5% per month or the maximum rate permitted by law, whichever is less. Additionally, we reserve the right to retain possession of the furniture until full payment is received.

4.5 Storage Fees

If you fail to pick up or accept delivery of completed furniture within 14 days of notification that the Project is complete, we reserve the right to charge a storage fee of PLN 50 per week or part thereof.

5. Delivery and Pickup

5.1 Delivery Services

We offer delivery services within a 50-kilometer radius of our workshop for an additional fee based on distance and the size of the furniture. Delivery fees will be included in the Quote if requested.

5.2 Pickup Arrangements

If you choose to pick up your furniture, it must be collected within 14 days of notification that the Project is complete. Pickup is available during our regular business hours or by appointment.

5.3 Risk of Loss

Risk of loss transfers to you upon delivery of the furniture to your specified location or upon pickup from our workshop.

5.4 Inspection at Delivery

You should inspect the furniture immediately upon delivery or pickup. Any visible damage or discrepancies must be noted on the delivery receipt or reported in writing within 48 hours.

6. Warranties and Guarantees

6.1 Workmanship Warranty

We warrant our workmanship for a period of 12 months from the date of completion. This warranty covers defects in the repair or restoration work performed by us under normal use conditions.

6.2 Exclusions

The warranty does not cover:

• Damage caused by misuse, abuse, accidents, or improper care
• Normal wear and tear
• Issues unrelated to the specific repairs or restoration work performed
• Damage caused by environmental conditions such as extreme humidity, heat, or dryness
• Modifications or repairs made by anyone other than us

6.3 Material Warranties

Any warranties on materials used in the repair or restoration process are limited to those provided by the manufacturer of those materials.

6.4 Claim Procedure

To make a warranty claim, you must contact us in writing within the warranty period, describing the defect in detail. We may require photographs or an in-person inspection to evaluate the claim. If the claim is valid, we will, at our option, repair or replace the defective work at no charge.

7. Intellectual Property

7.1 Our Intellectual Property

The Website, Services, and all Content, features, and functionality thereof, including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof, are owned by us, our licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Website and Services for your personal, non-commercial use, subject to these Terms.

7.3 Restrictions

You may not:

• Reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Website, except as permitted by these Terms
• Use any illustrations, photographs, video or audio sequences, or any graphics separately from the accompanying text
• Delete or alter any copyright, trademark, or other proprietary rights notices from copies of materials from this Website
• Access or use the Website for any commercial purposes

7.4 User Content

By submitting any User Content to the Website (such as before and after photos of your furniture), you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content in any media. You represent and warrant that you own or control all rights in and to the User Content.

8. Limitation of Liability

8.1 Disclaimer of Warranties

EXCEPT AS EXPRESSLY PROVIDED IN THESE TERMS, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8.2 Limitation of Liability

IN NO EVENT SHALL WE, OUR DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES
• ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES
• ANY CONTENT OBTAINED FROM THE SERVICES
• UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU TO US FOR THE SPECIFIC PROJECT GIVING RISE TO THE LIABILITY.

8.3 Exclusions

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you.

9. Indemnification

You agree to defend, indemnify, and hold harmless Furniture Repair, its directors, employees, partners, agents, suppliers, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your User Content
• Your use of the Services
• Your violation of any rights of a third party

10. Termination

10.1 Termination by Us

We may terminate or suspend your Account and access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

10.2 Termination by You

You may terminate these Terms by discontinuing use of the Services and closing your Account.

10.3 Effect of Termination

Upon termination, your right to use the Services will immediately cease. If you wish to terminate your Account, you may simply discontinue using the Services. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10.4 Project Cancellation

If you cancel a Project after work has commenced but before completion, you will be responsible for payment for all work performed up to the date of cancellation, plus any materials purchased specifically for your Project. The deposit is non-refundable.

11. Governing Law and Dispute Resolution

11.1 Governing Law

These Terms shall be governed and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.

11.2 Dispute Resolution

Any dispute arising from or relating to these Terms or the Services shall be resolved through the following steps:

1. Informal Negotiation: The parties will attempt in good faith to resolve any dispute promptly through negotiations between you and Furniture Repair.
2. Mediation: If the dispute cannot be resolved through negotiation within 30 days, either party may initiate mediation by providing written notice to the other party.
3. Arbitration or Litigation: If the dispute cannot be resolved through mediation within 60 days, either party may pursue legal remedies in the courts of Poland.

11.3 Class Action Waiver

YOU AND FURNITURE REPAIR AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by updating the "Last Updated" date at the top of these Terms and, in some cases, we may provide additional notice (such as adding a statement to our homepage or sending you a notification).

Your continued use of the Services after such changes constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future Terms, do not use or access (or continue to access) the Services.

13. General Provisions

13.1 Entire Agreement

These Terms constitute the entire agreement between you and Furniture Repair regarding the Services and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning the subject matter.

13.2 Severability

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of these Terms remain in full force and effect.

13.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of Furniture Repair.

13.4 Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt to assign or transfer these Terms without such consent will be null and void. We may freely assign or transfer these Terms without restriction.

13.5 Notices

Any notices or other communications permitted or required hereunder, including those regarding modifications to these Terms, will be in writing and given by Furniture Repair: (i) via email (in each case to the address that you provide); or (ii) by posting to the Website. For notices made by email, the date of receipt will be deemed the date on which such notice is transmitted.
